Managing poor performance when unfair dismissal rights start at six months' service”: workshop on legislation and case law

With unfair dismissal rights starting at six months' service and compensation for unfair dismissal being uncapped from 1 January 2027, properly managing the performance of all employees, whether new joiners or existing employees, is going to be more important than ever. To take us through this we are holding a workshop with an expert speaker providing case law examples and giving legal and practical guidance on getting the best out of your performance management processes. This will help protect your organisation from Employment Tribunal claims.

In this interactive workshop, Jon Taylor, Partner in EMW Law will bring us up to speed with the Employment Rights Act changes coming into force in January 2027 and then provide case law and practical guidance on methods for dealing with employee performance: getting it right at the recruitment stage, distinguishing between the “can’t” and “won’t”, getting the best out of the probationary period. The guidance will include identifying the employee who “flatters to deceive” during the probationary period. You will understand how putting the appropriate processes in place will identify and manage performance at an early stage.

About the speaker

Jon Taylor, Partner, heads the employment team for EMW Law.

He advises on a full range of employment and HR related matters for employers including TUPE, unfair discrimination and whistle-blowing. He provides training on HR matters for HR teams and for senior managers. He is an accredited CEDR mediator.
