The new Employment Rights Act has been the most revolutionary piece of employment legislation for at least 20 years. It also contains many provisions which are controversial and subject to widespread criticism.
Whatever your views, it is unarguable that all HR specialists, as well as the wider business community, will require to be familiar with its terms and implications. This includes considering the Government’s complicated calendar setting out when the new rights will become into force and making advance plans.
Ledingham Chalmers employment team has identified 5 key areas which all HR professionals should consider immediately.
These are:
1. Could the lifting of caps on Unfair Dismissal awards put business at risk and what steps should be considered in advance of this coming into force?
2. How vulnerable is business to claims of harassment by third parties?
3. Do the new fire and rehire restrictions mean businesses can only act when in real financial peril?
4. Will handling the restrictions on zero and limited hours be a full-time job and
5. Why the new 6 months qualification period for Unfair Dismissal clams is less than 6 months.
